These Terms of Service (“Terms”) are a legal agreement between you and Eli Gelb (“we,” “us”), operator of Biomize (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service.
Biomize is a personal, informational tool that aggregates data you provide or connect (such as biometrics, glucose, calendar, and manual logs) and surfaces trends, statistics, machine-learning forecasts, and AI-generated summaries to help you understand your own patterns. It is currently a private, invite-only beta.
The Service provides personal health intelligence and wellness insights from your own data, for informational purposes only. It is not a medical device, not an “AI doctor” or diagnostic platform, and it does not provide medical advice, diagnosis, or treatment. Insights, scores, forecasts, briefings, and recommendations are generated automatically (including by AI) from your data and may be incomplete or wrong. Do not use the Service to make medical decisions. Always consult a qualified healthcare professional with questions about your health, and never disregard or delay professional medical advice because of something in the Service. If you think you have a medical emergency, call 911 (or your local emergency number) immediately.
The Service is an evolving beta provided “as is.” Features may change, break, or be removed, and data may occasionally be lost. Do not rely on it as your sole record of any important information.
You are responsible for your account and for keeping your login secure. Tell us promptly at eligelb1@gmail.com if you suspect unauthorized use.
You own the data and content you provide. You grant us a limited license to store, process, and display it solely to operate and improve the Service for you, including sending the necessary portions to our service providers (see the Privacy Policy). You are responsible for having the right to provide any data you connect.
When you connect Oura, Dexcom, Google, or others, your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, and they may change or revoke access. You authorize us to access those accounts on your behalf to provide the Service.
Do not: use the Service unlawfully; access another person’s data; attempt to breach security; reverse-engineer or scrape the Service; resell it; or use it to provide medical care to others.
We own the Service software, design, and content (excluding your data). These Terms do not grant you any rights in our intellectual property except to use the Service as intended.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INSIGHT IS ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELI GELB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR HEALTH OUTCOMES, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $100.
You agree to indemnify and hold harmless Eli Gelb from claims arising out of your misuse of the Service or violation of these Terms.
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive (e.g., 3, 6, 9–12) survive termination.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in New York for any disputes, except where prohibited by law.
We may update these Terms. Material changes will be posted here with a new date and, where appropriate, in-app notice. Continued use after changes means you accept them.
